Still in the Drain: How Microbeads Continue to Contaminate American Waterways Despite Federal Law
When President Obama signed the Microbead-Free Waters Act into law in December 2015, environmental advocates described it as a rare moment of clarity in American pollution policy. The legislation targeted the tiny polyethylene spheres deliberately added to facial scrubs, toothpastes, and body washes—particles small enough to pass untreated through wastewater facilities and enter the nation's lakes, rivers, and ocean margins. The bill passed unanimously. The celebration, it turns out, was premature.
Nearly a decade later, measurable concentrations of microbead-sized plastic particles continue to appear in American waterways, and a growing body of research points directly back to personal care products as a persistent source. The question is not whether the law failed, but rather how precisely it was designed to succeed—and for whom.
What the Law Actually Covers (and What It Doesn't)
The Microbead-Free Waters Act applies specifically to "rinse-off cosmetics" containing intentionally added plastic microbeads. On its face, that sounds comprehensive. In practice, the definition creates meaningful exclusions that manufacturers have been slow to close and regulators even slower to address.
The Food and Drug Administration, which oversees cosmetics under the Federal Food, Drug, and Cosmetic Act, classifies products along a spectrum. A plain facial scrub is a cosmetic. A medicated acne wash that also exfoliates occupies dual status as both a cosmetic and an over-the-counter drug. Industrial-grade hand cleansers used in manufacturing facilities fall under occupational safety frameworks rather than cosmetics regulation. Certain leave-on skin treatments—moisturizers with exfoliating claims, for instance—were not universally captured by the rinse-off definition, and some manufacturers have exploited that ambiguity.
Then there is the nomenclature problem. When federal law prohibited "microbeads," it defined them narrowly as solid plastic particles measuring less than five millimeters added for exfoliating or cleansing purposes. Manufacturers responded, in some cases, not by reformulating but by renaming. Ingredient labels now feature terms such as "polyethylene microspheres," "nylon-12 powder," "acrylates copolymer," and "polymethyl methacrylate"—all of which describe plastic particles that function identically to the microbeads the law targeted, yet may not be captured by its technical language.
The Wastewater Treatment Gap
Even particles that regulators do identify as prohibited must first be intercepted before they reach open water. Wastewater treatment infrastructure in the United States was not designed with microplastics in mind. Conventional activated sludge processes remove a significant percentage of particles—some studies suggest between 70 and 99 percent—but that remaining fraction, released in treated effluent or embedded in biosolids applied to agricultural land, represents billions of particles entering the environment daily from American treatment plants alone.
A 2022 study published in the journal Environmental Science & Technology sampled effluent from 17 municipal wastewater facilities across five states and found detectable microplastic concentrations in every single discharge stream. Polyethylene and polypropylene particles—the chemical signatures of personal care product microbeads—were among the most consistently identified types. When those treated effluents discharge into rivers that feed coastal estuaries, the particles do not degrade. They accumulate.
The Great Lakes region illustrates the problem at scale. Researchers at the State University of New York at Fredonia documented microbead concentrations in Lake Erie sediment that rival those found in heavily industrialized marine environments. Lake Erie drains into the Niagara River, which feeds Lake Ontario, which eventually contributes to the St. Lawrence Seaway and the Atlantic Ocean. The drainage architecture of American geography means that a product rinsed down a sink in Cleveland may, in time, contribute to marine plastic budgets far from shore.
Enforcement: A Fractured Responsibility
Asking which agency enforces the Microbead-Free Waters Act produces a surprisingly complicated answer. The FDA holds authority over cosmetics. The Environmental Protection Agency oversees water quality standards but does not directly regulate cosmetic ingredients. The Consumer Product Safety Commission governs certain household products that may contain microplastics but are not classified as cosmetics. State attorneys general have occasionally pursued enforcement actions under consumer protection statutes, but those efforts are inconsistent and resource-constrained.
The result is a regulatory landscape where no single authority maintains comprehensive oversight. A manufacturer selling a product that contains polyethylene microspheres under a technical name not explicitly listed in FDA guidance may face little practical risk of enforcement, particularly if the company operates primarily through e-commerce channels where state-level inspections rarely reach.
California has moved to address this gap more aggressively than the federal government. The state's Department of Toxic Substances Control has proposed expanded definitions of regulated microplastics in personal care products, and California's Safer Consumer Products program includes provisions that could compel reformulation. Washington state passed its own microplastics legislation in 2023, covering additional product categories. But a patchwork of state laws does not substitute for coherent federal standards, and products manufactured in states without such requirements continue to circulate nationally.
The Consumer's Dilemma
For American consumers attempting to avoid microplastic-containing products, the current labeling environment offers little guidance. The FDA does not require manufacturers to identify synthetic polymer particles as a distinct ingredient category, meaning a shopper scanning an ingredient list must possess considerable technical knowledge to distinguish a natural exfoliant like walnut shell powder from a plastic microsphere described in chemical nomenclature.
Environmental advocacy organizations including Beat the Microbead maintain databases of flagged products and publish smartphone applications designed to help consumers identify problematic formulations. These tools are valuable but depend on voluntary manufacturer disclosure and regular database updates—neither of which is guaranteed.
Dermatologists and cosmetic chemists consulted for this article noted that effective natural alternatives to synthetic microbeads have existed for decades: sugar crystals, oatmeal, rice bran, and finely ground plant materials all provide exfoliating action without persisting in aquatic environments. The barrier to reformulation is not technical. It is economic, and in some cases, it reflects a deliberate calculation that regulatory pressure remains insufficient to compel change.
Closing the Loop
The Microbead-Free Waters Act was a meaningful first step, and its proponents deserve credit for achieving bipartisan consensus on a pollution issue at a moment when such consensus was increasingly rare. But first steps require follow-through, and the gap between the law's intent and its operational reality has widened rather than narrowed in the years since passage.
Closing that gap will require the FDA to update its definitions to encompass synthetic polymer particles regardless of their commercial nomenclature, the EPA to establish microplastic concentration limits in treated wastewater effluent, and Congress to consider extending microbead prohibitions to the product categories currently excluded. Until those actions materialize, American waterways will continue receiving a daily deposit from the nation's bathroom drains—a slow, invisible, and entirely preventable form of pollution that a celebrated law has not yet managed to stop.
